Welcome to ThatVariant. These Terms of Service ("Terms") govern your access to and use of our website (thatvariant.com), associated subdomains (*.thatvariant.com), Web Apps as a Service (WaaS), Progressive Web Apps (PWAs), digital product storefront, and support channels. By accessing our platform, purchasing subscriptions or digital products, or using our web applications, you agree to be bound by these Terms. If you disagree with any part, you are prohibited from using our services.

1. Architectural Model, Client Data Ownership & Offline Operations 

ThatVariant operates on a zero server-side business database architecture for its WaaS and PWA products.

• Your Data Ownership: All operational data created through your use of our applications—including customer rosters, sales logs, appointment records, and inventory data—resides directly inside your personal Google Drive and Google Sheets account. ThatVariant claims zero ownership over your operational business data.

• Service Availability: Our PWAs function by communicating directly between your web browser and Google API endpoints. ThatVariant is not responsible for operational downtime caused by third-party outages, including Google Workspace API interruptions or client network connectivity issues.

• Offline Functionality & Caching: Our applications may include offline functionality that caches data locally on your device (via local storage or IndexedDB) before it is synchronized to your Google account. You acknowledge and agree that:

  • Data is not backed up to your Google account until a successful synchronization occurs.

  • We are not responsible for the loss of any data that has not successfully synchronized due to network connectivity issues, browser cache clearing, or device failures.

  • You are solely responsible for the physical and digital security of the device(s) on which you use the service, and we are not liable for unauthorized access to locally cached data resulting from unsecured or compromised devices.

2. Intellectual Property & Scope of Use

 All software code, application UI/UX designs, automated Google Sheets structures/formulas, layout templates, brand graphics, and digital assets hosted on or generated by ThatVariant are the exclusive intellectual property of ThatVariant.

• Digital Asset & WaaS License Grant: Upon purchasing a web application tier, template, or digital product, ThatVariant grants you a limited, non-exclusive, non-transferable license to access and run the application or asset strictly for your personal use or internal operations within your single business entity.

• Prohibited Uses: You may not copy, reverse-engineer, decompile, resell, sub-license, lease, bundle, or publicly redistribute any portion of ThatVariant's application code, template structures, or subdomains to any third party. Automated scraping or commercial resale of our application frameworks is strictly prohibited.

3. Storefront Transactions, Account Verification & Billing

• Subscription & Access Entitlement: Product entitlements, user authentication, and tier access are managed through email address verification. Access privileges are granted automatically upon verified payment clearance.

• Merchant of Record: All billing, checkout transactions, and sales tax compliance are handled securely through our third-party Merchant of Record, Lemon Squeezy. By purchasing a product or subscription, you agree to abide by Lemon Squeezy’s terms and payment processing rules.

4. Custom Physical Business Logbooks & Amazon KDP Fulfillment 

For customers utilizing custom physical logbooks, operational ledgers, or notebooks designed by ThatVariant, the following fulfillment protocol applies:

• Phase 1: Design & Formatting: ThatVariant builds customized interior and cover layouts based on your submitted order specifications.

• Phase 2: Amazon KDP Review: Custom books are uploaded to our Amazon Kindle Direct Publishing (KDP) dashboard for print-on-demand manufacturing. Amazon enforces a mandatory manual review window (typically 3 to 5 business days) to verify print specifications. ThatVariant maintains no control over Amazon's review speeds.

• Phase 3: Availability & Purchase: Upon approval by Amazon, ThatVariant dispatches an automated alert email containing the direct retail URL. Physical printing, transaction processing, packaging, and logistical shipping are managed entirely by Amazon.

5. Refund & Cancellation Framework

• Digital Assets & WaaS Subscriptions: Due to the intangible nature of web applications, immediate access grants, downloadable templates, and digital files, all digital storefront purchases are structurally final once entitlement is granted to your account email. You may cancel recurring web app subscriptions at any time through your billing portal to prevent future renewals.

• Physical Amazon Marketplace Disputes: Because physical books are printed and shipped directly by Amazon, ThatVariant does not manage physical shipping delays or printing defects. For physical order issues, you must contact Amazon Customer Service directly through your Amazon account under "Your Orders."

6. Limitation of Liability 

ThatVariant provides all web apps, digital tools, templates, and services on an "as-is" and "as-available" basis without warranties of any kind, expressed or implied. In no event shall ThatVariant, its founder, or its affiliates be liable for any indirect, incidental, consequential, or financial losses arising from data loss, synchronization failures, Google Account access revocation, software incompatibility, or operational downtime resulting from the use or inability to use our products.

7. Changes to Terms 

We reserve the right to modify these Terms at any time. Updated versions will be posted directly to this page with an updated "Last Updated" date. Continued use of our platform following changes constitutes acceptance of the revised Terms.
